1. Agreement to Terms

By accessing or using FAQai.app (“the Service”), operated by FAQai Ltd (“we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

These terms apply to all visitors, users, and others who access or use the Service, whether on a free or paid plan.

2. Description of Service

FAQai.app is an AI-powered software-as-a-service platform that enables users to upload documents (PDF, DOCX, TXT) and automatically generate structured training and evaluation datasets for retrieval-augmented generation (RAG) chatbots.

3. User Accounts

To access certain features you must register for an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

• You must provide accurate and complete information.
• You must be at least 18 years old to create an account. By registering, you confirm your age via the age verification checkbox during sign-up.
• You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Upload content that is unlawful, defamatory, or infringes on third-party rights.
• Attempt to reverse-engineer, disassemble, or decompile any part of the Service.
• Use automated means (bots, scrapers) to access the Service beyond the provided API.
• Interfere with or disrupt the integrity or performance of the Service.

5. Intellectual Property

You retain ownership of all documents you upload. The generated dataset output is owned by you. We retain all rights to the Service itself, including its underlying technology, branding, and interface.

You grant us a limited, non-exclusive licence to process your documents solely for the purpose of providing the Service.

6. Payment Terms

Paid plans are billed in advance on a monthly or annual basis. Prices are listed in GBP and are exclusive of applicable taxes. All fees are non-refundable except as described in our 30-day money-back guarantee.

• Upgrades take effect immediately; downgrades take effect at the next billing cycle.
• We reserve the right to change pricing with 30 days' notice.
• Failed payments may result in suspension of your account after a 7-day grace period.

7. Data Processing

We process your uploaded documents using AI models to generate dataset content. Documents are encrypted in transit (TLS 1.3) and at rest (AES-256). We do not use your documents to train our AI models. See our Privacy Policy for full details.

8. Limitation of Liability

To the maximum extent permitted by law, FAQai Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability for any claim arising out of or relating to these terms shall not exceed the amount paid by you to us in the 12 months preceding the claim.

9. Termination

You may terminate your account at any time from your Settings page. We may suspend or terminate your access if you violate these terms, with or without notice. Upon termination, your data will be retained for 30 days before permanent deletion unless you request earlier deletion.

10. Data Protection

We are committed to protecting your personal data in accordance with applicable data protection laws worldwide. For full details on how we collect, use, store, and protect your data, please refer to our Privacy Policy and GDPR Compliance page.

We comply with the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA/CPRA), Brazil's LGPD, Canada's PIPEDA, South Africa's POPIA, Singapore's PDPA, Japan's APPI, and Australia's Australian Privacy Principles (APPs). You can exercise your data rights via Settings > Privacy in your account or by contacting our Data Protection Officer at dpo@faqai.app.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Notwithstanding the above, nothing in these Terms shall limit or exclude any mandatory consumer protection rights that apply to you under the laws of your country of residence. In particular, if you are located in the European Union, United Kingdom, Brazil, Australia, or any other jurisdiction with mandatory consumer protection laws, those local laws shall take precedence where they provide greater protection than these Terms.

12. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or an in-app notification at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised terms.
